1. Seller & Contract
These Terms & Conditions are between you and Cuore Di Caffe Ltd, a company registered in Malta ("we", "us", "our"), the provider of the Restauranteur software service. By signing up, subscribing, or continuing to use the service, you agree to these terms.
2. Product Description
Restauranteur is a web-based restaurant and café management platform. It includes modules for daily sales tracking, supplier invoice management, stock and wastage logging, staff rostering, clock-in/clock-out, wage calculations, VAT summaries, fixed cost tracking, and live profit & loss reporting. Access and feature availability depend on your subscription plan and assigned role.
3. Acceptance of Terms
By creating an account, subscribing, or otherwise using Restauranteur, you confirm that you accept these terms and agree to comply with them. If you do not agree, you must not use the service.
4. Authority
If you are using Restauranteur on behalf of a business, you warrant that you have authority to bind that business to these terms. If you are an individual, you confirm you are of legal age to form a binding contract in your jurisdiction.
5. Account & Credentials
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use.
6. Acceptable Use
You must not use Restauranteur for any unlawful purpose, fraud, spam, or to infringe the intellectual property rights of others. You must not attempt to interfere with the security of the service, including through malware, probing, scraping, or reverse engineering.
7. Intellectual Property
Cuore Di Caffe retains all ownership rights in Restauranteur, including software, documentation, branding, and related IP. You are granted a limited, non-exclusive, non-transferable licence to use the service within the terms of your subscription.
8. Service Level
We aim to keep Restauranteur available and operational, but we do not guarantee uninterrupted or error-free performance. Scheduled maintenance and unforeseen technical issues may result in temporary downtime.
9. Payment, Billing & Subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. 10. Accuracy of Information
You agree to provide accurate and complete information when setting up your account and business profile, and to keep that information up to date.
11. Warranties & Liability
Restauranteur is provided "as is". To the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose. Our aggregate liability is limited to the fees you paid in the 6 months preceding the claim. We are not liable for indirect, consequential, or special damages, except where prohibited by law.
12. Suspension & Termination
We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. Upon termination, your data may be deleted after a reasonable export window.
13. User Content
You retain ownership of data you input into Restauranteur. You grant us a limited licence to host and process that data solely to provide the service to you.
14. Governing Law
These terms are governed by the laws of Malta. The courts of Malta have exclusive jurisdiction over any dispute arising out of or in connection with these terms, without regard to conflict-of-law principles.
15. Changes to Terms
We may update these terms from time to time. We will notify you of material changes via email or within the app. Continued use after changes constitutes acceptance.
